  • Giving reasons as a means to enhance compliance with legal norms

Daphna Lewinsohn-Zamir, Daphna Lewinsohn‐Zamir et al.•ARTICLE•University of Toronto Law Journal•2022

The threat of sanctions is often insufficient to ensure compliance with legal norms. Recently, much attention has been given to nudges – choice-preserving measures that take advantage of people’s automatic System 1 thinking – as a means of influencing behaviour without sanctions, but nudges are often ineffective and controversial. This article explores the provision of information about the reasons underlying legal norms, as a means to enhance co…

  • It's Now Or Never! Using Deadlines as Nudges

    Open Access•Eyal Zamir, Daphna Lewinsohn-Zamir et al.•ARTICLE•Law & Social Inquiry•2016•Citada por: 2•Referencias: 3

Incorporating behavioral insights into regulation is plausibly the most significant development in regulatory theory and practice in recent years. Behaviorally informed regulation encourages self-benefiting and socially desirable behaviors with little intrusion on autonomy. Drawing on new empirical findings, this article puts forward the hitherto overlooked possibility of employing the deadline effect as a regulatory tool. Deadlines serve as an a…

  • The importance of being earnest

Daphna Lewinsohn-Zamir, Daphna Lewinsohn‐Zamir•ARTICLE•University of Toronto Law Journal•2015

Through its use of sanctions and rewards, the law can affect people’s conduct in two ways: by modifying only their external behaviour (‘behavioural change’) or by changing their underlying preferences as well (‘preference change’). In both cases, the legal rules can be said to have been ‘internalized’ – however, while in the former instance the individuals’ conduct conflicts with their values, attitudes, and beliefs, in the latter it coincides wi…

  • Behavioral Law and Economics of Property Law

Daphna Lewinsohn-Zamir, Daphna Lewinsohn‐Zamir et al.•CHAPTER•The Oxford Handbook of Behavioral…•2014

This chapter critically surveys the behavioral law-and-economics literature on property law. First, it sketches the main features of existing studies and their tendency to excessively focus on certain topics, such as the home. The chapter then discusses various issues with respect to which behavioral analysis has made an impact, such as the characterization of property as a “thing” or as a “bundle of sticks,” compensation for takings of property,…

  • The Questionable Efficiency of the Efficient-Breach Doctrine

    Daphna Lewinsohn-Zamir, Daphna Lewinsohn‐Zamir•ARTICLE•Journal of Institutional and…•2012

The doctrine of efficient breach is based on the belief that the risk of postcontractual bargaining failure under property rules is greater than the risk of the courts' miscalculation of damages under liability rules. The article presents the findings of two experiments that challenge this belief and suggest that courts systematically undercompensate promisees. Implementation of the efficient-breach doctrine might therefore lead to underdeterrenc…
