  • Governmental practices of regularisation

    David Moffette•ARTICLE•International Journal of…•2024

In the contested politics of mobility, programs to regularise undocumented immigrants act simultaneously as progressive tools for social inclusion, and as bordering devices organised around states' assessment of desirability. This article studies these dynamics during the most significant regularisation program in Canada's history, the 1973 Adjustment of Status Program. Drawing on an analysis of institutional archival material, parliamentary deba…

  • The Violence of Everyday Police Disrespect

    David Moffette, Chris Bruckert•ARTICLE•Deviant Behavior•2023•Cited by: 2•References: 45

Scholarship on police violence tends to either center the historical role of the institution in protecting an unequal social order or the individual use of force. To broaden our understanding and unpack how violence manifests in everyday interactions, we examined 251 accounts of police encounters in Ottawa, Canada. Finding that disrespect was disturbingly common, we developed a typology that highlights the spectrum of police disrespect as it mani…

  • Immigration status and policing in Canada

    David Moffette•ARTICLE•Citizenship Studies•2021•Cited by: 5•References: 66

Bridging prison and immigration justice is of utmost importance, and an obvious and strategic point of encounter for dialogue among activists and scholars working on these issues is immigration detention. But as penal and carceral abolitionists have taught us, we cannot tackle prison injustice without addressing broader issues in policing, criminal law and other means of coercive social control. Taking my cues from this work, I suggest that we mo…

  • Immigration et criminalisation au Canada

    Open Access•David Moffette, David Moffette1•ARTICLE•Criminologie•2019•References: 29

  • Governing Irregular Migration

    David Moffette•BOOK•Governing Irregular Migration•2018

This thorough analysis of immigration governance in Spain explores the dynamics of inclusion and exclusion at play at one of Europe’s southern borders. David Moffette analyzes Spain’s processes of immigration governance and reveals the complicated series of legal obstacles facing many migrants. Differential access to border mobility is a central concern of contemporary politics, and nowhere is this more apparent than in the European Union, where …

  • Flickering Presence

    Open Access•David Moffette, William Walters•ARTICLE•Studies in Social Justice•2018•Cited by: 13•References: 29

Analytics of biopolitics and government have proven to be powerful tools in a growing scholarship examining the bordering, surveillance, securitization and contestation of migratory processes. Yet the critical potential of such research is hampered by the rather limited ways it has managed to make sense of race and racism. While Foucault was insistent that governmentality should orient itself to the understanding of singularities, too often race …

  • The jurisdictional games of immigration policing

    Open Access•David Moffette•ARTICLE•Theoretical Criminology•2018•Cited by: 17•References: 17

The article maps out the multilayered legal governance of immigrant street vendors in Barcelona. The case study is used to develop the literature on crimmigration by suggesting better ways to account for the dynamic, asymmetric, and uneven legal intersections at play in immigration governance. Questioning the idea of a merger between immigration law and criminal law that scholars of crimmigration often imply, the article suggests that it is the h…

    Open Access•David Moffette, Nevena Aksin•ARTICLE•Canadian Journal of Law and…•2018•Cited by: 4•References: 1

Following the arrival of the MV Ocean Lady in 2009, four men were charged with human smuggling under s. 117 of the Immigration and Refugee Protection Act for having helped Sri Lankan asylum seekers reach Canada. Section 117 made it a criminal offence to aid and abet the unauthorized entry of asylum seekers, including when this was done for humanitarian reasons, to help family members, or as a matter of mutual aid. The case made its way to the Sup…

  • Sanctuary City Organizing in Canada

    Open Access•David Moffette, Jennifer Ridgley•ARTICLE•Migration and Society•2018•Cited by: 23•References: 8

In recent years, migrant justice organizers in Canada have developed campaigns aimed at building, legislating, and enforcing municipal commitments to alleviating and resisting the harms done by federal immigration enforcement, and ensuring migrant access to municipal services. As a result of these efforts, some cities, including Toronto, Montreal, Vancouver, and Hamilton, have declared themselves "sanctuary cities," and campaigns centered around …

  • Uninhibited violence

David Moffette, Shaira Vadasaria•ARTICLE•Critical Studies on Security•2016•Cited by: 19•References: 49

Bringing a critical race analysis to existing literature on securitization, this article addresses a lacuna in securitization theory and offers a conceptual framework to account for the entanglements between the securitization of immigration and racial violence. First, we consider the limits of the concept of securitization to account for the normality of racial violence, and argue that responses to events deemed to be ‘crises’ need to be analyze…

  • Governing immigration through probation

    Open Access•David Moffette•ARTICLE•Security Dialogue•2014•Cited by: 10•References: 8

Lacking an effective recruitment strategy and wanting to satisfy the demand for immigrant labour, Spanish authorities facilitated the entry of (mostly) Latin American ‘tourists’ in the early 2000s, knowing that many were migrants entering Spain to reside and work irregularly. This strategy is one of postponing control – a strategy of displacing some of the filtering work performed by borders and immigration selection across space and time. In thi…

  • Muslim Ceutíes, Migrants, and Porteadores

    Open Access•David Moffette•ARTICLE•The Canadian Journal of Sociology•2013•Cited by: 1

This article analyzes the differential problematizations of 'Muslim Ceutíes,' 'migrants,' and 'porteadores' (carriers) in the Spanish border town of Ceuta located on the south shore of the Gibraltar Strait in North Africa. I argue that convivencia, a local discourse and practice of tolerance meaning 'living together,' can be analyzed as a regime for governing differences premised on tolerance, and nevertheless contributing to the reproduction of …

Ceuta is a Spanish city in Northern Morocco. It is thus situated at a European Union border on the African continent. In this context, I contend that migration is generally considered a potential threat to the pacified local order of things by the Christian majority. In order to protect this order of things referred to as convivencia, Christian Ceutíes tend to prefer depoliticizing strategies to manage migration. Nonetheless, migration sometimes …
