Devaluing Sustainability
The long-awaited European Supply Chain Act, known as the EU Corporate Sustainability Due Diligence Directive (CSDDD), entered into force on July 25, 2024, has been criticized as a missed opportunity to advance more impactful protections for vulnerable stakeholders of global value chain capitalism. Concluding a lengthy, contested legislative process, the Directive’s adoption reflects the diverse trends that make up global value chain (GVC) governa…

"The Oxford Handbook of Transnational Law offers a comprehensive compendium for the field of Transnational Law [TL] by providing a unique and unparalleled treatment and presentation in an area that has become one of the most intriguing and innovative developments in legal doctrine, scholarship, theory as well as practice today. Economic Law
This article revisits the improbable concept of “economic law,” which originated in early- and mid-twentieth-century debates in search of a magical triad: a legal-political framework for a capitalist economy under democratic control. In analyzing its composite elements both in retrospect and in the current pandemic context, it becomes obvious how the elements generate complicated, potentially destructive dynamics with one another. The recently re…
Les Jeux Sont Faits
This invited commentary offers a number of reflections in response to a recent article by Pierre Legrand. In that article, several frontlines are drawn between what Legrand considers the right and the wrong ways of doing comparative law. The following commentary tries to make sense of both the origin and direction of what oftentimes comes across as an overly harsh and even polemical critique of different scholars who are active in the field.
Beyond Territoriality
Taking “extraterritoriality,” the traditional touchstone for the state-centered allocation of transnational legal authority, as its conceptual starting point the book traces the evolution of transnational legal authority in the course of globalization. It examines various representative transnational legal scenarios, covering issues of, inter alia, the environment, foreign trade and investment, corporate governance, criminal justice, cyberspace, …
Comparative, global and transnational constitutionalism
Comparative lawyers have for more than a century sought to increase the understanding of ‘foreign’ legal orders and regulatory systems. Despite some never fully resolved methodological questions, great advances have been made in the comparative study of different regulatory areas both in ‘private’ (contract, tort, corporate, labour) and ‘public’ law (administrative law, environmental law). Comparative constitutional law [CCL] has emerged as a fie…
Law, Economics and Evolutionary Theory
Neither ‘Public’ nor ‘Private’, ‘National’ nor ‘International’
This paper contends that the challenging nature of the regulation of global corporate conduct requires an adequately differentiated approach towards the identification and analysis of the norms in question. In part I, I review the context of ‘state intervention’ and ‘market self‐regulation’, in which the current discussion of regulatory responses to the economic/financial crisis and the role of self‐regulation occurs, before laying out the concep…

Law After the Welfare State
This paper analyzes the contemporary emergence of neo-formalist and neo-functionalist approaches to law-making at a time when the state is seeking to reassert, reformulate and reconceptualize its regulatory competence, both domestically and transnationally. While the earlier turn to alternative regulation modes, conceptualized under the heading of "legal pluralism," "responsive law," or "reflexive law" in the 1970s and 1980s, had aimed at a more …
