Law, Surveillance and the Humanities
The growing sophistication of surveillance practices has given rise to concerns and discussions in the public sphere, but has also provided a popular theme in literature, film and the arts. Bringing together contributors across literary studies, law, philosophy, sociology, and politics, this book examines the use, evolution, legitimacy, and implications of surveillance. Drawing on a range of resources including literary texts, chapters explore ke…
Chris Barker, Educating Liberty
Since the 1990s, there has been a revival of interest in citizenship education as a means to revitalize democratic participation with the works of Gert Biesta (Learning Democracy in School and Society : Education, Lifelong Learning, and the Politics of Citizenship, Rotterdam: Sense Publishers, 2011). Amy Gutmann in Liberal Equality (Cambridge: University Press, 1980 : 55) acknowledges Mill as a precursor of the idea that human development is fost…
Nudges and the limits of appropriate interference
The starting point of the present paper is the nudge phenomenon. The most disturbing element of nudge is its potential for individual manipulation, that is, for relying on initiatives that go beyond the acceptable limits of interference in individual choice. This feature is not ignored by nudge advocates, who discuss it extensively to justify the overriding benefits of such initiatives. In this discussion, they acknowledge the seminal importance …
Beyond Foucault
Back to the sources of nudges
Nudges are becoming an increasing part of the daily lives of individuals, consumers and citizens. They have problematic implications in respect to individual freedom, autonomy, and, by the same token, of potential choice manipulation that could arise from them. There is therefore a vital need both to understand the workings of these tools based on human psychology, and to determine whether they are legitimate interferences in individual choices. …
Nudges

Effects of the open method of coordination (OMC) in research and innovation
This study offers new insights on the open method of coordination (OMC) of the European Union (EU) by focusing on the effects of this new method for producing EU regulation. The starting points here are that the OMC is not a radically new method of governance, and that it must be seen as an application of the theory of indirect legislation – as developed by Bentham. With the concept of indirect legislation, Bentham thinks a system of governing in…
The Fallacy of Informed Consent
Orthodox contract law theory assumes that parties agree to the terms of a contract before entering into an agreement. However, recent factual evidence points towards the fact that consumers do not systematically read, and thus become informed of, the terms of a contract. Academics are asking for mandatory frameworks to ensure that informed consent is indeed sought and given by parties to a contract. The present study looks into the user agreement…

Utilitarian Biopolitics
The works of Foucault and Bentham have been regularly examined in isolation and in reference to Panopticon; or The Inspection House (1791), yet rarely has the relationship between the two philosophers been explored further. This study traces the full breadth of that relationship within the fields of sexuality, criminology, ethics, economics and governance. By drawing on a range of new source material, Brunon-Ernst presents a convincing reassessme…

Bentham and Tocqueville on Pauperism
Alexis de Tocqueville and Jeremy Bentham belong to two different generations. When Tocqueville made his firt trip to the South of England in 1833 and, the following year, when the publication of De la Démocratie en Amérique launched his career as a successful political writer, Bentham had died a couple of years before. Bentham had certainly never heard about a young hopeful French writer called Tocqueville. At least there is no mention of his nam…

La traduction de l’Introduction to the Principles of Morals and Legislation par le Centre Bentham
