  • Polar Bears and Gavels

Open Access•Daniel Bertram, George Hill•ARTICLE•Journal of International Criminal…•2024

This article analyses the increasingly pervasive enrolment of visual materials in the evolution and contestation of international criminal justice. We posit that this emerging field of ‘visual advocacy’ is transforming how international criminal law is produced and perceived. Visual advocacy stands to complement and reinforce, but also to challenge and subvert conventional norms and narratives. To probe how these dynamics play out in practice, we…

  • For You Will (Still) Be Here Tomorrow

    Open Access•Daniel Bertram•ARTICLE•Transnational Environmental Law•2023•Cited by: 2•References: 20

This article traces the various legal incarnations of the intergenerational equity principle. Despite its silent proliferation in international and constitutional laws over the past five decades, the principle dwelled mostly at the margins of inquiry and practice. Recent efforts to counteract global warming have allowed intergenerational claims to gain new traction. Building on a comparison of ten climate-related lawsuits, I analyze the latest ad…

  • Environmental Justice “Light”? Transnational Tort Litigation in the Corporate Anthropocene

    Open Access•Daniel Bertram•ARTICLE•German Law Journal•2022

Corporations are notoriously powerful actors in the current configuration of our globalized economy. Their activities play a key role in shaping a new age of ecological precarity—the Anthropocene. Much of this environmental damage occurs in cross-border settings, hampering victims’ access to legal remedies due to widespread corporate impunity and institutional hurdles in host states. Several transnational lawsuits have recently tested the willing…

  • Judicializing Environmental Governance? The Case of Transnational Corporate Accountability

    Daniel Bertram•ARTICLE•Global Environmental Politics•2022•Cited by: 6•References: 9

The transnational scope of corporate activities often results in extraterritorial environmental harm elsewhere on the planet. Within the European context, two legal developments are challenging this state of affairs. First, several legislative initiatives seek to establish due diligence standards for corporate activities along global supply chains. Second, domestic courts increasingly assume jurisdiction over environmental damage arising from cor…

  • Accounting for Culture in Policy Transfer

    Open Access•Daniel Bertram•ARTICLE•Political Studies Review•2022•Cited by: 4•References: 98

In recent years, the burgeoning literature on transnational dissemination of policies has moved beyond orthodox models to incorporate the institutional context by means of social-constructivist approaches. This article engages in a critical review of the status quo by arguing for the importance of an overlooked key variable in policy transfer research: culture. Particularly, it is contended that culture plays an under-acknowledged role in co-shap…

  • Factoring in Societal Culture in Policy Transfer Design

    Open Access•Daniel Bertram, Ammar Maleki et al.•ARTICLE•Journal of International…•2020•Cited by: 6•References: 53

The Canadian model of private sponsorship schemes (PSS) for refugees is becoming an increasingly popular target for policy transfer in the field of migration. This article argues that the influence of societal culture on this transplanting process has played an underexplored role in the literature. We seek to provide original guidance for factoring in cultural elements into the policy transfer framework by demonstrating how specific design choice…
