  • NDAs

    Open Access•Renata Grossi•ARTICLE•Alternative Law Journal•2025

Evidence suggests that non-disclosure agreements (‘NDAs’) are widely used. Instead of their intended use of protecting trade secrets and commercially sensitive information, they were exposed during #MeToo as tools to hide sexual harassment and assault. Evidence suggests they remain pervasive and pernicious, and require more scrutiny. As contracts, how legally enforceable are they? The article will attempt to answer this question by applying some …

  • What can contract law learn from #MeToo

    Open Access•Renata Grossi•ARTICLE•Journal of Law and Society•2022

In this article, I ask whether contract law can learn anything from the #MeToo discussions of consent. When we juxtapose consent in these two contexts, two issues emerge. The first is whether consent is a valuable ethical tool in helping us to determine whether an agreement is ‘good’. This article argues that just as patriarchy makes a mockery of consent in negotiating sexual encounters, so too do free market economics make a mockery of consent a…

  • Law, emotion and the objectivity debate

    Renata Grossi•ARTICLE•Griffith Law Review•2019

This article will argue that emotional thinking and decision-making does not lead to an abandonment of objectivity when we drill down and consider what precisely we mean by both emotion and objectivity in law. In doing this I do not necessarily wish either to accept or to challenge the importance that objectivity occupies in our legal thinking, but merely to reconsider its definition and hope for a more nuanced conversation around its significanc…

  • The discomfort of Thorne v Kennedy

    Open Access•Renata Grossi•ARTICLE•Alternative Law Journal•2019

The 2017 High Court case of Thorne v Kennedy highlighted and sparked discussion around the injustice of financial agreements and when they may constitute unconscionability and undue influence. However, the case also raises another important discussion about the relationship between love and money. This article picks up this conversation. How does society navigate the distinctions we make between economic exchange and romance? Between altruism and…

  • Love as a Disadvantage in Law

    Open Access•Renata Grossi•ARTICLE•Journal of Law and Society•2018

Love is not often the explicit subject of legal discussion but when it is, it appears as a negative phenomenon that leads us to make bad decisions. This view of love is amplified in the context of commercial and economic transactions, where love, intimacy, and economic exchange are seen as operating under opposing principles. This article questions the accuracy and efficiency of law when it operates under both of these assumptions, and argues for…

  • The meaning of love in the debate for legal recognition of same-sex marriage in Australia

    Open Access•Renata Grossi•ARTICLE•International Journal of Law in…•2012•Cited by: 3•References: 9

Love is ever-present in the debate for the legal recognition of same-sex marriage. Its importance, however, is often underestimated. I will show in this article that much can be gained by viewing this issue through the analytical lens of romantic love. This analysis will show that romantic love is a contested idea. On the one hand it claims to embody a radical and permissive ideology that is capable of penetrating established social and cultural …
