  • A Non-Mentalistic Account of Corporate Agency and Responsibility

    Herlinde Pauer-Studer•ARTICLE•Social Theory and Practice•2024

The purpose of this paper is twofold. First, it aims to show that there is a way to consider corporations and organizations as agents without attributing to them mental states such as beliefs, desires, and intentions. Looking at the constitutional setup and structure of corporations and organizations, as well as the professional status and role of its principal operative members, provides us with sufficient information to classify them as agents.…

Open Access•Rubin Assis da Silveira Souza, Herlinde Pauer-Studer•ARTICLE•ethic@ - An international Journal…•2021•References: 2

  • Justifying Injustice

    Open Access•Herlinde Pauer-Studer•BOOK•Justifying Injustice•2020

Post-war legal scholars commonly consider the Third Reich's judicial system to be the paradigm of 'evil law'. By examining how crucial parts of this distorted normative order evolved and were justified by regime-loyal legal theorists, we can appreciate how law can bend to a political ideology and fail to keep state power from transgressing elementary standards of humanity and the rule of law. From 1933 to 1939, a flood of publications reflected o…

  • Rational Requirements and Reasoning

    Open Access•Herlinde Pauer-Studer•ARTICLE•Economics and Philosophy•2014•Cited by: 2•References: 4

This critical note concerns John Broome's book Rationality through Reasoning (2013). Broome claims that rationality amounts to satisfying rational requirements as opposed to responding correctly to reasons. My critique focuses on two issues. First, I try to show that Broome's account of rational requirements, in particular his answer to the so-called ‘symmetry-problem’, presupposes that responding correctly to reasons is part of rationality. Seco…
