In the Shadow of the Constitution
Across the world, the significance or role of Constitutions is too often understood in ways that ignore how they actually touch the lives or shape the political imaginations of ordinary people. Similarly, countries in the Global South, those that are not conventional liberal democracies, and those that have recently experienced conflict are generally underrepresented in the comparative constitutional law literature. Drawing on ethnographic insigh…
Decay and Recovery of CSR Routines in Franchise Organizations
Saffron Suffrage
As one of the world’s only constitutions to recognize Theravada Buddhism as the state religion yet not include a religious exemption to the universal franchise for its monastic community, Cambodia’s Constitution stands out as an anomaly. This article traces the ways in which the realities of this remarkably inorganic approach to religion—enshrined in Cambodia’s Constitution in 1993, pursuant to a heavily internationalized peace process—have subse…
New constitutional rites
Globalisation is radically reconfiguring traditional understandings of constitutional law. A prime example of this trend would be the International Finance Corporation, whose Performance Standards have been described as a private-law Bill of Rights. Focusing on a complaint brought to the IFC’s Compliance Assessment Ombudsman by 17 villages in northeastern Cambodia, this article investigates how supranational frameworks interact with local identit…

Authoritarian Constitutional Borrowing and Convergence in Cambodia
Outlawing Opposition, Imposing Rule of Law
Cambodia's Constitution, promulgated in September 1993, was to be the foundation of a transition to liberal, multiparty democracy. Yet, despite the document's seeming commitment to those very principles, constitutional provisions are frequently used to undermine liberal rule of law and to impose restrictions on political processes, freedoms, and rights. Focusing on the events of 2016–2017, including the jailing of opposition politicians, controve…
The Moderating Role of Hotel Type on Advertising Expenditure Returns in Franchised Chains
This study contributes to a deeper understanding of financial returns from the advertising of hospitality services. Specifically, we investigate how different types of franchised hotel outlets, each targeting a different customer segment, moderate the effects of various advertising expenditures on unit-level profitability. Our unique data set allows us to examine the impact of unit-level advertising expenditure allocations using line items from t…
African Asylum at a Crossroads
This book examines the emerging trend of requests for expert opinions in asylum hearings or refugee status determinations. It is the first to explore the role of court-based expertise in relation to African asylum cases and the first to establish a rigorous analytical framework for interpreting the effects of this new reliance on expert testimony. Courts in Western countries and beyond have begun demanding expert reports tailored to the experienc…
