Snip, snip, cure”? Philosophical, legal and biomedical perspectives on novel somatic genomic therapies
The advent of innovative techniques, such as the CRISPR/Cas system, has opened up a new range of possibilities for modifying the genome, with the potential to address previously unmet therapeutic needs of patients with genetic diseases. These new possibilities have not only raised ethical concerns but also challenged existing classifications of genome modification techniques. While the legal status of some of these new therapies remains uncertain…
Wesentlichkeitstheorie und Pandemiegesetzgebung
More than three years have passed since the outbreak of the COVID‐19 pandemic in Germany in early 2020. At the beginning, it was the »moment of the executive« to control this state of health emergency. Nevertheless, shortly thereafter, parliament was called upon to amend, inter alia, the Infectious Diseases Protection Act. In constitutional terms, the call for legislation by parliament echoes the Federal Constitutional Court's »essential-matters …
Gesetzliche Regelung der pandemiebedingten Triage
The 4th edition of the first volume of this work provides an update of the commentary on the preamble and articles 1 to 19 in case law and literature. The structure of the book has been retained and its content supplemented by more recent developments, such as the implications of Europeanisation and digitalisation as well as the Corona pandemic. As of the 4th edition, Frauke Brosius-Gersdorf has taken over the editorship of the commentary.
Import and Impacts of the ECHR and the Judgments of the ECtHR in the Russian and German Legal System
In modern constitution-based states, it is, as a rule, the national constitution which determines whether, and to what extent, public international law takes effect in the domestic legal sphere. Accordingly, states may limit or even exclude the validity or applicability of public international law for constitutional reasons. This holds true for the European Convention on Human Rights (ECHR) and the judgements of the European Court of Human Rights…
The Yukos Cases. A Comparative Case Note on the ECtHR’s Decisions and the PCA Tribunal’s Awards
The decisions on the Yukos cases delivered by the European Court of Human Rights (ECtHR) in \n2009/2011/2014 and by an international arbitral tribunal administered by the Permanent Court of \nArbitration (PCA Tribunal) in 2009/2014 call for a comparative analysis. The two judicial bodies \narrived at highly divergent conclusions, in particular with regard to the amount of damages to be \npaid by Russia: according to the Tribunal, Russia had to pa…

Internet Governance became one of the most hotly debated issues during the World Summit on the Information Society (WSIS) in 2003 and 2005. Discussions focussed on ICANN's and the US' dominant position in Internet Governance. ICANN coordinates domain names, Internet protocol addresses as well as the Root Server system and, thus, core resources of the Internet's infrastructure. It exercises its functions under contracts with the US Department of C…
Korporative Staatsgewalt
