  • Section 36 of the Limitation Act 1980

    Open Access•Paul S Davies•ARTICLE•The Cambridge Law Journal•2023

The law concerning limitation periods has long been recognised to be unsatisfactory. One area which poses particular problems concerns whether a limitation period can apply to equitable claims “by analogy” under section 36 of the Limitation Act 1980. This article considers three relatively recent decisions of the Court of Appeal – P & O Nedlloyd BV v Arab Metals Co. (The UB Tiger) [2006] EWCA Civ 1717, [2007] 1 W.L.R. 2288, The Commissioners for …

  • Remedies for Breach of Trust

    Open Access•Paul S Davies•ARTICLE•Modern Law Review•2015•References: 5

The decision of the S upreme C ourt in AIB Group ( UK ) Plc v Mark Redler & Co confirms the approach taken by L ord B rowne‐ W ilkinson in Target Holdings Ltd v Redferns : where a trustee misapplies trust assets, a beneficiary is limited to a claim for equitable compensation for losses caused by the trustee's breach of duty. This seems to be a departure from traditional equitable doctrine, which held that the beneficiary could falsify the trustee…

  • Rectifying the Course of Rectification

    Open Access•Paul S Davies•ARTICLE•Modern Law Review•2012•Cited by: 1•References: 6

In Daventry District Council v Daventry & District Housing Ltd [2011] EWCA Civ 1153, the majority of the Court of Appeal held that a contract should be rectified because of a common mistake. This note discusses that decision and recent developments in the law of rectification. It is argued that the approach of the majority in Daventry is unsatisfactory, and that an emphasis upon ascertaining whether the parties have objectively made a common mist…

  • Poverty Among Elderly Women

Kalman Rupp, Alexander Strand et al.•ARTICLE•The Journals of Gerontology…•2003•Cited by: 8•References: 1

The SSI program is target efficient in providing a broad safety net to economically vulnerable elderly women. The relationship between SSI and Social Security and the relationship between the SSI asset and income tests have to be reevaluated to make the program more effective and appropriate to changing household structure and work patterns among the elderly population

  • A Conditional Logit Approach to U.S. State‐to‐State Migration

    Open Access•Paul S Davies, Michael J Greenwood et al.•ARTICLE•Journal of Regional Science•2001

This paper uses a conditional logit approach to study interstate migration in the United States for each of eleven years, from 1986–1987 to 1996–1997. We test substantive hypotheses regarding migration in the United States and demonstrate the richness of the conditional logit approach in studies of place‐to‐place migration. We investigate migration responses to relative economic opportunities (unemployment rate, per capita income) and the associa…

  • Sober on Brandon on Screening-Off and the Levels of Selection

    Open Access•Robert N Brandon, Janis Antonovics et al.•ARTICLE•Philosophy of Science•1994•Cited by: 1•References: 11

Sober (1992) has recently evaluated Brandon's (1982, 1990; see also 1985, 1988) use of Salmon's (1971) concept of screening-off in the philosophy of biology. He critiques three particular issues, each of which will be considered in this discussion
