It is not so much the Van Gend & Loos judgment, but rather the ECJ's current approach that is novel and comes close to a constitutional revolution. Thus, the effects of EU law before national courts no longer depend on the identification of norms that by their nature can have direct effect. In »technical« areas of law, direct effect may simply be stated. Where important or constitutional principles or values are at stake, the method of mutual amp…

Multilateral Investment Rules Revisited
This chapter addresses the question of whether it is possible to retain a multifaceted and multi-layered system of bilateral and regional agreements, which leads to what some have termed a ‘spaghetti-bowl’ of legal instruments, or whether it is necessary to reform that system by way of multilateral disciplines on foreign investment. Section 1 sets the scene by examining the current international regulation of foreign investment and discussing pre…
The Kadi Case - Constitutional Core Values and International Law - Finding the Balance
The Kadi judgment of the European Court of Justice has provoked severe criticism. The Court’s dualist approach was described as unfaithful to its traditional fidelity to public international law and inserting itself in the tradition of nationalism. However, we argue that the Court indicated a possible opening to allow for precedence of Security Council measures, if sufficient safeguards for human rights are created. Moreover, it seems that the Se…

Witzemann v. Hauptzollamt München Mitte
Max Witzemann had been sentenced to a prison term for counterfeiting in 1982. According to that nonappealable decision, he had imported counterfeit U.S. dollar notes into Germany in 1981. On the basis of the decision, the Hauptzollamt sought to collect customs duties and turnover taxes on the import of the forged notes.
