Selecting among Acquitted Defendants
We consider two means for implementing the informational benefits of the Scottish verdict (a three-outcome verdict) in a two-outcome legal system. Leipold proposed allowing defendants to choose to be tried under the two-outcome or the three-outcome verdict. In equilibrium, all defendants choose the three-outcome verdict, which requires a wholesale shift of the legal system (something unlikely to occur in, for example, the U.S.). Alternatively, we…
Platform-Intermediated Trade with Uncertain Quality
Products Liability, Signaling and Disclosure
We examine the behavior of a firm that produces a product with a privately-observed safety attribute. Costly disclosure and price-signaling of safety are alternative firm strategies. The liability system and production cost determine the firm's full marginal cost. When the firm's full marginal cost is increasing (decreasing) in safety, a firm with a safer product will distort its price upward (downward) and will sometimes inefficiently choose to …
Economic Theories of Settlement Bargaining
We briefly review two basic models of settlement bargaining based on concepts from information economics and game theory. We then discuss how these models have been generalized to address issues that arise when there are more than two litigants with related cases. Linkages between cases can arise because of exogenous factors such as correlated culpability or damages, or they can be generated by discretionary choices on the part of the litigants t…
Cournot Oligopoly
Celebrating the 150th anniversary of Cournot's work, which Mark Blaug has characterized as 'a book that for sheer originality and boldness of conception has no equal in the history of economics thought', this volume focuses on the properties and uses of Cournot's model of competition among the few. While there are many issues that Cournot explored in researches into the mathematical principles of the theory of wealth, the topic that he is most re…
An Econometric Analysis of Changes in the Cost and Production Structure of the Trucking Industry, 1953-1982

Regulation and Industrial Organization
This paper examines the effects on firm behavior and industry structure of industry-wide price regulation by the state. Such regulation, wherein regulators set prices with regard to an industry-wide aggregate performance measure, has been (and still is) widely used and is shown to induce inefficiencies in firm operation. In general such regulation can result in setting prices high enough to maintain inefficient firms, and it encourages to ineffic…
The Estimation of a Hybrid Cost Function for a Railroad Firm
Ronald R. Braeutigam, Andrew F. Daughety, Mark A. Turnquist, The Estimation of a Hybrid Cost Function for a Railroad Firm, The Review of Economics and Statistics, Vol. 64, No. 3 (Aug., 1982), pp. 394-404
An Analysis of Regulatory Change in the Transportation Industry
HIS paper develops and applies a model for analyzing regulatory change in the freight transportation industry. The model incorporates multiple product markets, multiple transport modes and imperfect competition between the modes. An application of the model to consider some of the consequences of extending the Interstate Commerce Commission's agricultural exemption to the railroads, for the movement of corn in the Midwest, is provided. The analys…
