Peace Treaties in the Confines of the Spanish Empire
This article aims to analyze the practice of early modern law of nations – rather than its well-known doctrinal debate – in the Spanish empire. To do so, I focus on Hispano-Mapuche parliaments held in the south of colonial Chile during 1605, in which certain native customs, such as Mapuche polygamy, were temporarily recognized after concluding a series of peace agreements. Thus, this article claims that Hispano-Mapuche peace depended on validatin…
The study of natural law in Coimbra, Seville, and Santiago de Chile (Eighteenth and nineteenth centuries)
This article seeks to establish a comparative analysis of the reforms to the study of natural law in Coimbra, Seville, and Santiago de Chile. The main goal is to find differences and similarities in the implementation of legal educational reforms in the Catholic legal culture at the end of the eighteenth century and the beginning of the nineteenth century. In this context, we argue that the introduction of the theory of modern natural law in thes…
Localisation of International Law Narratives in the Nineteenth Century
The present research analyses particularities and dynamics of a non-European normative order such as that in South America in the nineteenth century. Thus, this research argues that the Spanish bombardment of the Chilean port of Valparaíso in 1866 helped locally recreate international law narratives such as the standard of civilization and the civilizing mission. Paradoxically, the bombardment of Valparaíso strengthened the self-perception of the…
The Co-creation of Imperial Logic in South American Legal History
This study is part of the current trend of expanding ‘histories of international law’. From a regional perspective, I analyse not just the South American dimension of the process known as the ‘universalization of international law science’, but also focus on the ‘ideological use’ of ius gentium europaeum in the debate on the occupation of indigenous territories governing by the nation Mapuche in the south of Chile (1861–1883) and then the discuss…

Historia y derecho internacional
The following paper analyses the historical and imperial turns in the legal international scholarship with the goal of rethinking the function of the history in the actual understanding of international law. For this, we would want to employ the contributions of the approaches from global history, history of encounters, cultural studies, postcolonial legal critic and history of empires
This article aims to reconstruct the process of censorship to the work De Iure Naturae et Gentium (Lund 1672) of the German jurist Samuel Pufendorf. Specifically we focus on the common points of controversy and friction within the Protestant and Catholic intellectual culture that generated the idea of state proposed in this work in context of early German enlightenment. As we try to prove, the processes of censorship of books make up an important…
