  • Constitutional Judging under Pressure

    Open Access•Başak Çalı, C Costello et al.•ARTICLE•German Law Journal•2025

Introducing the Special Issue on “Judging under Pressure,” this Article sets out three interlinked challenges facing constitutional courts, broadly understood: persisting inequalities, the climate crisis, and rising autocratization. The Articles in this Special Issue identify, analyze, and prescribe a set of judicial responses and strategies when judging under pressure. Some reimagine and recalibrate the role of judges, while others respond with …

  • Notstand vs. Asylrecht

    Nora Markard•ARTICLE•KJ / Kritische Justiz•2025

    Nora Markard•ARTICLE•JuristenZeitung•2019

    Anuscheh Farahat, Nora Markard•ARTICLE•JuristenZeitung•2017

  • The Right to Leave by Sea

    Nora Markard•ARTICLE•European Journal of International…•2016•Cited by: 6

The EU and its member states are progressively involving third countries in their border control measures at sea. Relevant instruments of cooperative migration control range from capacity building measures to joint patrols in third-country territorial waters and shared surveillance intelligence on ship movements. So far, the discussion on migration control at sea has mainly focused on the illegality of ‘push-backs’ of migrant boats by EU member s…

  • Contested Collisions’

Open Access•Kerstin Blome, Nora Markard•ARTICLE•Leiden Journal of International Law•2015•References: 4

This article examines the problem of colliding international regimes by reference to the International Criminal Court (ICC) and the UN Security Council. Given the different logics or rationalities of these institutions – the Security Council is first and foremost a (power) political organ, while the ICC is in charge of legal assessments – the collision potential is high. A collision rule was therefore introduced into the Rome Statute in the form …

  • Das Recht auf Ausreise zur See Rechtliche Grenzen der europäischen Migrationskontrolle durch Drittstaaten

    Nora Markard•ARTICLE•Archiv des Völkerrechts•2014

Over the past decade, the EU and its Member States have increasingly involved third countries in border control measures intended to prevent »illegal immigrants« from reaching Europe by land or sea. Cooperation agreements with third countries comprise joint coastal patrols, shiprider agreements, the deployment of liaison officers, border control capacity-building measures, as well as sharing intelligence, especially within the border surveillance…

Die andere Frage stellen: Intersektionalitt als Analysekategorie im Recht 1 "The way I try to understand the interconnection of all forms of subordination is through a method I call 'ask the other question.' When I see something that looks racist, I ask, 'Where is the patriarchy in this?'
