The Elements of Law: Manuscripts and the Short Parliament
There are eleven known manuscripts of Hobbes’s Elements of Law . As they divide on textual grounds into two groups, they are effectively two separate editions, employing two different texts. While two of the manuscripts apparently were Hobbes’s working copies, it also seems clear that he never definitively established the text of the Elements . There are reasons for thinking it unlikely that, as has been suggested, Hobbes intended the work to inf…

Progress Report on Editing Hobbes’s Elements of Law for the Clarendon series
This is a progress report on efforts to edit Hobbes's Elements of Law for the Clarendon series of his works. The Elements was first printed in 1650 in two separate volumes, with the titles Humane Nature and De Corpore Politico, but these printings (Wing H2242 and H2219) were not approved by Hobbes, and lack textual authority. In 1650 it was well known that Hobbes planned to bring out a book on human nature -or de homine (on man) -and another on bod…

Andrew Mansfield. Ideas of Monarchical Reform: Fénelon, Jacobitism and the Political Works of the Chevalier Ramsay
Andrew Mansfield’s Ideas of Monarchical Reform: Fénelon, Jacobitism and the Political Works of the Chevalier Ramsay is a scholarly, well-written, and entertaining book. It discusses the political ideas of Andrew Michael Ramsay (1686–1743), and places them in their French and British contexts. Mansfield argues convincingly that British and French thought cross-fertilized each other in the age of the early Enlightenment, and that modern scholarship…

The Discourse of Legitimacy in Early Modern England
Whatever its title may suggest, this book is about political and religious thought between the Henrician Reformation and the meeting of the Long Parliament. It is concerned with the ways in which people legitimated claims to power in church and state. More strictly, its subject is the ‘political languages’ (p. 2) employed by English people. The various languages in question, Professor Zaller contends, singly ‘and collectively ... constitute a dis…

English and European Political Ideas in the Early Seventeenth Century: Revisionism and the Case of Absolutism
The central argument of this article is that English political thinking in the early seventeenth century was not distinctively English. More particularly, we shall see that a number of English writers put forward political doctrines that were precisely the same as those of Continental theorists who are usually described as absolutists. If the Continental thinkers were absolutists, then so were the English writers. The theory of absolutism vested …

History and Theory: The Norman Conquest in Early Stuart Political Thought
Orthodoxy maintains that English political thinking before Hobbes was based upon an unphilosophical, precedent-bound reading of history. According to J. G. A. Pocock, Sir Edward Coke typically held that English customary law was pre-historical and that the continuity of English traditions had never been broken by conquest. Conquerors possessed sovereign power; in England there had been no conqueror; so there was no supra-legal sovereign. English …
From Suarez to Filmer: A Reappraisal
English political thought in the early seventeenth century is often regarded in terms of the disagreements between the king and his parliaments, and of debates amongst lawyers on the nature and contents of the ancient constitution. But a large proportion of the political writings of early seventeenth-century English theorists was directed against the views of Catholic authors. Sir Robert Filmer devoted much of his Patriarcha to refuting the theor…

The Royal Supremacy and Episcopacy ‘Jure Divino’, 1603–1640
Laudian divines cried up the king's prerogative. But they also affirmed that episcopacy was by divine, not human right. Was jure divino episcopacy, which many clerics asserted in the decades after Bancroft's famous sermon of 1589, in fact incompatible with the traditional English theory of the Royal Supremacy? Catholics and extreme puritans answered this question in the affirmative, and many recent commentators have accepted their judgement. The …

Absolutism and royalism
The purpose of this chapter is to describe the main tenets of absolutist and royalist thinking in the seventeenth century. That century, we are often told, saw the making of absolutism, especially in France. There, the Estates General fell into disuse after 1615, and its demise brought death to the principle that taxation requires the consent of the taxed. In the 1620s Louis XIII subdued the Huguenots in a crusade which harnessed militant Catholi…
Sir Robert Filmer: Patriarcha and Other Writings
In seventeenth-century England, patriarchalist thinking shaped English ideas not only about the family but also about society and the state. Many thinkers argued that the state should be seen as a family, and that the king held the powers of a father over his subjects. The classic texts of patriarchal political thinking were written by Sir Robert Filmer (1588–1653), one of the most acute defenders of absolute monarchy. In addition to presenting h…
