Abstract: This article aims to discuss the theme of the Common from the sight of Roman law, focusing on the analysis of property, from the method of the legal counterpoint between different paradigms. In order to achieve this general objective, the article was divided into two distinct parts: at first, the emergence of the commons was explained, through specialized authors in this subject; in a second moment, it was verified how the Roman Law dealt with properties that today can fit into what is called common. The deductive approach method was used through a bibliographic research. In the end, one could answer the question "how can Roman law contribute to a legal foundation of the common". In general, it can be concluded that there are contributions found in the Institutes of Gaius, Justinian's Digestion, and in the very conception of the Republic of the Romans, which can be used by law. Keywords: commons; human rights; political institutions; social participation; republicanism
