Law as a Lens for Understanding Design

In this article, which serves as an introduction to a special section of Design and Culture dedicated to design and the law, I propose four reasons why scholars of design would do well to make greater use of the law as a lens for understanding design. First, national laws and international agreements, especially those related to intellectual property (IP), tend to make greater demands of designers and manufacturers than they do of artists. Second, as a result, both designers and design historians have a greater need to understand the law than practitioners and scholars in other fields. Third, differences in the laws of various nations have significant but insufficiently recognized impacts on the behaviors of designers and manufacturers and thus on national design cultures. Fourth, as a result, it is important—sometimes even essential—to study design from a national perspective. Every nation has its own peculiar configuration of laws that can provide useful insights into its national design culture
