The so called refugee crisis is not a crisis of refugees but a crisis of human rights and democracy in Europe. It must be analyzed in a postcolonial context as the return of the repressed colonial past of all Europe. During the last two years this led to a total reversion of guilt. Instead of globalized and disembedded capitalism the African and Oriental people were suggested as existential threat of European welfarism. The essay argues that the real problem is the present state of European and national political institutions and public spheres. Increasing liberal and progressive mentalities of potential majorities have no chance to reach any political campaign, therefore they do not manifest themselves in public. However, the present crisis could lead to an end of European constitutional blockade. It is time for a complete re-foundation of the European project that is deeply entangled with the constitutional history of the African continent
