The fundamental legal objections which the Church of England has made to same-sex marriage are so general and far reaching as to have implications even beyond the scope of the Marriage (Same Sex Couples) Act 2013. If these arguments are accepted, introducing same-sex marriage into the law of England and Wales will be an inevitable and unacceptable threat to religious freedoms. This article assesses the claim that the recognition of same-sex marriage by the state is, by its very nature, incompatible with religious liberty and also, whether the establishment of the Church of England is at risk as a result.
