The crime of homicide in Roman law cannot be defined as modern criminal law defines it, since the very concept of “murder” was not always easily distinguished from lawful killing, an element of paternal power and of the Imperium of some magistrates, for a very long time; and because in the most archaic stages of its development, criminal law was more focused on concepts such as blood vengeance or the Pax Deorum than on repression of murder in itself.
