IN his article published in the July 1991 issue (Volume 44, Number 4, pp. 644-60), Alan B. Krueger, citing anecdotal evidence, states that groups in some states actually support and sponsor unjust-dismissal (p. 658). A logical hypothesis to explain why employer and employee groups often jointly support just cause dismissal laws, he suggests earlier in the paper, 's that such laws are an acceptable compromise between limited employer liability and assumption of fault (p. 653). Krueger says that the evidence he finds and the hypothesis he invokes to explain it are inconsistent with the conventional political economy view of unjust-dismissal legislation . . . which predicts that such protective legislation will be supported by employees and opposed by (p. 653, fn. 16). Our own research and experience with the issue of unjust dismissal indicate that employers and employer organizations have almost always opposed unjust-dismissal legislation. Except for the state of Montana, we know of no instances in which employers have taken the initiative to propose legislation in response to judicial decisions modifying the employment-at-will doctrine.
