Public arbitration of legitimate environmental interests : the example of [french] laws on mountains and coasts. Pierre Lascoumes. The problems raised by the implementation of the Mountain law (9 January 1985) and the Coastal law (3 January 1986) show the role of legal standards in environmental policies. They organize the reconciliation of three major categories of legitimate interests : economic and social development, regional planning, and environmental protection. Law operates in very flexible ways which distribute paths of action open to all the actors involved. It has a modest role in behavior moderation, participating together with other economic and social factors in its orientation, but not in its management. Public intervention often limits itself to articulating the legitimate interests which must be protected without setting criteria for ranking them precisely and determining each one's due. The regulation procedures designed to reconcile interests in each case remain open to the activity of the local actors and their balance of power. Regulatory action thus appears ambiguous in its objectives and its means ; it rarely deserves criticism as unilateral command. Only a sociology of its forms of mobilization makes it possible to understand what it authorizes
