In a comparative project between Delhi and Johannesburg, a set of questions is asked about the application of the law and the ability of groups of urban actors to access and negotiate for exceptional treatment. Two case studies will be examined: the 2006 "Sealings case" Delhi, which led to the closure of thousands of small commercial activities across the city and mass protests; and the 2008 Olivia Road case, in Johannesburg, which looked at the issue of housing rights and evictions. From these cases three sets of actors across the two cities will be compared: in India, the urban middle-class and the Delhi traders; and in Johannesburg, the poor inner city residents. The argument will be made that rather than providing for equal treatment for all, the court offers a site for negotiating exceptional treatment for specific groups. Furthermore the paper will demonstrate how a set of mutual interests and shared projects between the courts and litigants provides for better access and more sympathetic hearing and decisions
