Intellectual property rights management involves the conscious and planned creation, acquisition and development of intellectual property rights to implement an institution’s mission [Pantalony, Rina Elster. 2013. “Managing Intellectual Property for Museums.” World Intellectual Property Organization. https://www.wipo.int/publications/en/details.jsp?id=166; Pluszyńska, Anna. 2020. “Copyright Management by Contemporary Art Exhibition Institutions in Poland: Case Study of the Zachęta National Gallery of Art.” Sustainability 12 (4498): 1–23. https://doi.org/10.3390/su12114498]. It seems like a truism to say that museums worldwide adopt different intellectual property management policies. As a result, some more willingly open their collections, while others remain hesitant. However, discussions rarely address the causes of differences in the approach to this subject. In response to the existing cognitive gap, the authors posed the following research problem: what sociocultural, political–legal and economic mechanisms affect the decision-making process in the field of intellectual property management in museums? To explore this issue, the authors conducted a qualitative empirical research: interviews with representatives of 20 European museums and umbrella organisations that associate and represent museums on a national or international scale. The study results indicate that the human factor particularly influences the chosen intellectual property management policy
