Parliamentary reform and governmental effectiveness in Canada

Proposals for parliamentary reform tidally concentrate on improving parliament's competence as a critic of public policy and administration, as a prod to executive responsiveness, and as an agency for political education. Opponents of such proposals make much of the need to reserve undiminished the power of the political executive, seen as indispensable to ‘responsible government.’ In this paper, the values affirmed by both sides in this controversy are adopted as criteria in terms of which the present institutional arrangement, and any proposed alteration to it, out to be evaluated. On that basis, an analysis is made of the probable consequences of three leading reform proposals, namely, to strengthen the standing committee system, to abolish the so‐called ‘confidence convention,’ and to adopt pre‐legislative inquiries as routine procedure. Each of these reforms is found to have certain advantages and disadvantages compared to the status quo. Choice therefore required a partial value ranking among the criteria of assessment. This done, the analysis concludes that on balance the best course is to adopt pre‐legislative inquiries as routine procedure. Sommaire. De façon typique, les propositions de réforme parlementaire ont surtout pour but de rendre le parlement plus compétent comme critique de la politique et de l'administration publique, comme stimulant pour faire réagir les responsables et come agence d'éducation politique. Les adversaires de ces propositions insistent sur le besoin de maintenir intégralement le pouvoir de I'Exécutif, ce qui leur semble indispensable pour préserver la fonne gouvemementale dite “responsible government”. Dans cette communication, l'auteur a adopté comme critères d'évaluation des dispositions institutionnelles actuelles ou de toute modification qu'on pourrait leur proposer, les valeurs dont se reven‐diquent les deux côtés dans cette controverse. Sur cette base, il analyses les conséquences probables de trois principales propositions de réforme: le renforcement du système de commissions permanentes, l'abolissement de la convention parlementaire dite “confidence convention” et l'adoption comme procédure usuelle des enquêtes pré‐législatives. Il considère que chacune de ces réformes présenterait certains avantages et certains inconvénients par rapport au statu‐quo. Le choix demande donc l'étabhsement, même imparfait, d'une échelle de valeurs quant aux critères d'évaluation. Ceci fait, il conclut son analyse en déclarant qu'après avoir pesé le pour et le contre, il serait préférable d'adopter les enquêtes pré‐législatives comme procédure habituelle
