  • Günter Frankenberg, Comparative Constitutional Studies

    Open Access•Richard S Kay, Richard Kay•ARTICLE•The American Journal of…•2019

Few fields of legal study are as introspective as comparative law. It is fairly obvious that scholars would try to analyze and elaborate the rules of contracts, succession, or administrative law. Those subjects affect people every day. It takes some thinking, on the other hand, to figure out why anyone should care about how and why German and Canadian judicial qualifications differ. In fact, a hefty chunk of comparative law scholarship concerns, …

  • Technology and Operational Safety - Pros and Cons for Police Officers [Leading Edge]

    Open Access•R F Kay, Richard Kay•ARTICLE•IEEE Technology and Society…•2014

The point of view (POV) camera is a compact portable device carried by police officers that captures video/audio records of operational situations. However, this technology may create serious repercussions in post-incident investigations, if the differences between human and camera perception are not understood. In addition, POV cameras pose specific issues for officer safety. Data integrity is a crucial issue for the legal process after the fact…

  • The geopolitics of dependent development in Central Africa

    Richard Kay, R P Kay•ARTICLE•Commonwealth and Comparative…•2011•References: 74

This paper explores dependent development, industrialisation and transitions to the semiperiphery, examining tensions between geopolitics, racial and class conflict that evolved into a ‘reciprocal blockade’ in the Central African Federation (CAF), comprising Southern Rhodesia (now Zimbabwe), Northern Rhodesia (Zambia) and Nyasaland (Malawi). The 1923 transfer of power from the chartered British South Africa Company to a semi-autonomous, settler-d…

  • Constituent Authority

    Richard Kay•ARTICLE•The American Journal of…•2011•Cited by: 2•References: 38

The force of a constitution, like the force of all enacted law, derives, in significant part, from the circumstances of its enactment. Legal and political theory has long recognized the logical necessity of a “constituent power.” That recognition, however, tells us little about what is necessary for the successful enactment of an enduring constitution. Long-term acceptance of a constitution requires a continuing regard for the process that brough…

  • Constitutional Courts as "Positive Legislators" in the United States

Laurence Claus, Richard Kay•ARTICLE•The American Journal of…•2010•Cited by: 1

This Report asks whether American courts that decide constitutional cases, and ultimately the Justices of the United States Supreme Court, may be characterized as legislators, and in particular, as “positive” legislators. After defining the terms, the report reviews the Supreme Court's practice of constitutional lawmaking and considers academic and political reactions to that practice. The Report concludes with an account of challenges that the C…

Richard S Kay, Richard Kay•ARTICLE•The American Journal of…•2006

This essay, a revised version of the United States report on Euthanasia to be presented at the XVII International Congress of Comparative Law, surveys the state of the law, both decisional and statutory, on the permissibility of compassionately motivated actions to terminate human life. It deals with a range of legal categories: suicide, attempted suicide, euthanasia, assisted suicide and the termination of life-sustaining treatment. It highlight…

    Richard Kay•ARTICLE•Modern Language Notes•2003

According to Beatrice, January is being unwintered "because of the hundredth part that is neglected below." The seasonal slippage to which she refers is not, as is generally supposed, due to the Julian calendar, but rather to the precession of the equinoxes, which significantly is also the reason for postulating the existence of an eighth sphere, the Primum Mobile, where this speech occurs

  • The Albigensian twentieth of 1221–3

    Richard Kay•ARTICLE•Journal of Medieval History•1980•Cited by: 1•References: 1

In June 1221 Pope Honorius III gave legatine powers to three French archbishops, with a mandate to do what was necessary to promote the second Albigensian Crusade. Above all, what the Church's champion in Languedoc, Amalric de Montfort, needed was money so that he could hire mercenaries to fight against the successfully resurgent Provencal nobility. Accordingly, each of the archbishop-legates conferred with the bishops of his legation (in council…

    Open Access•Richard Kay•ARTICLE•Church History•1965•References: 5

The two Rouen provincial councils that were held in May 1281 and October 1282 are known only from three petitions addressed to Pope Martin IV that survive in a single manuscript. One was printed by Champollion-Figeac in 1839, another by Professor Gaines Post in 1936, but the third remains unpublished because its historical interest has not been apparent. The first two can be readily related to famous events of their day: one urged the canonizatio…

Denial may be prognostically favorable in patients with acute myocardial infarction. We analyzed the significance of denial in 26 patients referred to a tertiary care center for advanced therapy of unstable angina. Group A comprised 14 patients characterized as deniers on the Hackett--Cassem Denial Scale. Group B comprised 12 nondeniers. There were no differences between groups in multiple baseline social and demographic characteristics, cardiac …
