  • Dynamism, use and reuse at an Irish portal tomb

Open Access•Cormac Mcsparron, Brian Sloan et al.•ARTICLE•Proceedings of the Royal Irish…•2025

Excavations of a portal tomb at Tirnony, Co. Derry/Londonderry in 2010 and 2011 revealed a surprisingly dynamic monument with evidence for Neolithic ritual. The excavation uncovered pre-tomb pits, a disturbed stone floor, and primary tomb deposits, containing Neolithic pottery, flint tools, struck quartz and possible hammer-stones. There were indications of the sequence of construction of the elements of the tomb, and of interruptions, of unquant…

  • Detrimental reliance and the family home

    Open Access•Brian Sloan•ARTICLE•The Journal of Social Welfare Law•2023•References: 1

In Hudson v Hathway [2022] EWHC 631 (QB) (noted Sloan 2022), Kerr J excited much controversy by suggesting that detrimental reliance may not need to be shown by a joint legal owner seeking to establish an increased share of the family home under a common intention constructive trust. In a swiftly following judgment ([2022] EWCA Civ 1648), however, the Court of Appeal reaffirmed the requirement of detrimental reliance in both ‘sole’ and ‘joint nam…

  • Parental Guidance, State Responsibility and Evolving Capacities

    Claire Fenton-Glynn, Brian Sloan•BOOK•Parental Guidance, State…•2021

This book arises out of a CRC Implementation Project colloquium on Article 5 of the UN Convention on the Rights of the Child. Article 5 protects the responsibilities, rights and duties of parents or others to provide, in a manner consistent with the evolving capacities of the child, appropriate direction and guidance in the exercise by the child of his/her rights. In this interdisciplinary collection, leading international scholars address the in…

  • Adoption from Care

    Open Access•Brian Sloan•ARTICLE•International Journal of Law…•2021

Adoption from state care is one of the most controversial issues in child law, particularly where it is performed without parental consent. While recognising the complexity of the interests involved, the editors of this volume boldly assert ‘that the rights of the child often come second to parental rights’ in this context (p. 1), pessimistically observing that ‘there is little use of evidence to support the present balance between the different …

  • The ‘Chimera’ of Parenthood

    Open Access•Brian Sloan•ARTICLE•Modern Law Review•2021

In apparently the first reported instance of a paternity test being ‘fooled’ by a ‘human chimera’, a man ‘failed’ a paternity test because the genetic material in his saliva was shown to be different from that in his sperm. Such a chimera has extra genes, here absorbed from a twin lost in early pregnancy. The result was that the 'true' genetic father of the man's son was the twin, who had never been born. Chimeras present a challenge to legal sys…

  • Adoption decisions in England

Brian Sloan•ARTICLE•The Journal of Social Welfare Law•2015•Cited by: 1•References: 1

In Re B (A Child) (Care Proceedings: Appeal) [2013] UKSC 33 the Supreme Court President emphasised that ‘adoption of a child against her parents’ wishes should only be contemplated as a last resort – when all else fails’ because of adoption’s draconian nature. Re B has been cited dozens of times by the lower courts in the short time since it was decided. The aim of this article is to assess whether the influence of Re B is a matter of substance o…
