Legal moralism revised
This article explores how disciplinary sanctions imposed on legal professionals can be given a coherent moral justification. Drawing inspiration from the philosophy of criminal law, it develops a modified form of legal moralism based on role morality rather than common morality. The theory is intended to provide disciplinary authorities with normative guidance on what may legitimately be defined as a disciplinary offence, as well as limits on wha…
Utilitarian Explanation of Institutional Human Rights
Pursuing the Unjust Lawsuit
Every lawyer faces a constant and daunting question: how can one represent those people? Or, put differently, how can one defend an unjust case? This paper aims to address these issues by analysing the Italian tradition of legal ethics, with particular attention to the Galatei - notably the works of Belli and Giuriati, two leading Italian lawyers. These works are books of professional etiquette and good manners, intended to compensate for the abs…

The Problem of Recognition of Human Rights
This paper analyses Robert Alexy’s explicative-existential justification of human rights. The author identifies several problems that are associated with it. An analysis of Alexy’s explicative argument suggests that it cannot cope with the transition from facts to norms. Notably, this argument does not explain why its requirements cannot be overruled by some other moral reason (for example, the utility principle). The answer that Alexy offers in …
Explicative-Existencial Justificacion of Human Rights Analysis of Robert Alexy's Argument in Context of Is-Ought Problem
This paper analyzes Robert Alexy's explicative-existential justification of human rights. According to the author, there are two problems connected with this concept. It cannot establish human rights universally and explain why we should accept them. In the paper, these questions are addressed in the context of the Is-Ought problem. Alexy's approach is compared with other theories that strive for human rights justification (basic needs approach, …
Theory of Needs as Justification of Human Rights
This paper deals with the theory of needs as a possible justification of human rights. First, it defines the concept of need, which differs from the concept of want. It states that need is, by definition, objective in nature. The paper then analyses some concepts of need (especially those of David Miller and Massimo Renzo) and examines their advantages and disadvantages in relation to justification theories (for example James Griffin's approach w…
